If you’ve ever read a book on real estate investing, you’ve read that the best deals come from motivated sellers. Now how do you find one?

Motivated sellers? My wife and I were trying to keep the renters happy, the rent coming in and the house repaired – while living 2100 miles away. You bet I was motivated. We just sold our house last month and even got a good price, but I’ll tell you a secret. We would have sold the place for… well I don’t want to stress out the buyer if he reads this. Let’s just say we would have sold it for much less.

There’s your first clue on finding a motivated seller. If his property isn’t where he is, he’s probably ready to deal. How do you get this information? By asking. Talk to the real estate agent, the neighbors, and anyone else who might know something useful. Here are some other things to watch for that may indicate a motivated seller.

1. Relocation. If you hear that the seller is relocating for work, ask when he will be moving. He may already be worrying about those double payments.

2. Divorce. Divorce or relationship problems create many motivated sellers. Often a house payment needed both parties and will have to be sold quickly.

3. Financial problems. A failing business, too much debt or other financial problems often force a sale. Find out if the owner is behind on payments.

4. Tenant problems. It is easy to get tired of being a landlord. It is also common to want to get out at any reasonable price.

5. Probate. If the house is in probate, and the heirs are all waiting to get their inheritance, they may be more interested in a quick sale than a great price.

6. Up-sizing or down-sizing. Owners moving into a larger or a smaller home may already have one in mind and need to sell quickly.

More Clues For Finding A Motivated Seller

Another way to find motivated sellers is to pay attention to the wording of ads in the classifieds. Statements like, “Need to sell,” “Must sell,” and “Will look at all offers,” are good indicators. “Must have a good job,” in a rental ad may indicate a landlord that is tired of tenants and ready to sell. Some other methods:

1. Find neglected properties. If they aren’t maintaining the property, they may be short on cash, tired of it, or out of town – all good motivators.

2. Use property tax rolls. Go to the county records, which are open to the public in most places. What you are looking for is properties that list an owner with an address far away. You could have found us this way, and bought our place for less than we got.

3. Use timing. Just before school starts, people are motivated to get their house sold so they can get their kids enrolled in the new school where they are moving. If an apartment building has been sitting there for sale for the whole winter, the owner may be tired of the bills and ready to get it sold fast.

The bottom line is to use your eyes and ears and look for the clues. Talking to people helps a lot. However you find your motivated sellers, the next step is to motivate them even more, by giving them what they want. Start by negotiating for a fast, easy closing for them – and a good price for you. One of the biggest problems people run into when selling their home is the process of preparing it for sale. Many homes are simply places where we keep the accumulated treasures of the years. Are you a clutter-bug, a pack-rat? It’s OK, we all are to some degree. When preparing a home for sale, we need to be mindful of our “stuff.” The best way to begin this process is to take a quick walk through your home. Make a list of everything that you have not used in the past 3 months, 6 months? Now, and here is the hard part. Get rid of it. Seem a bit extreme? It might, but things that you have not used in half a year are not likely to get used in the future. Remember we are trying to get rid of some stuff so that people can see the house, not what’s in it.

There is a common line of thought that home buyers want to see the “personality” of the homes current owners. This is not true. Buyers want to be able to see their belongings in the home. They want to put their personality into it to see if they could see themselves living there. A backlog of your stuff will get in the way of them doing this. Go through every room in turn and remove the clutter! This includes the closets, shelves and cupboards. Also remove excess furniture if the room seems too crowded. Making money in real estate is always going to be an option, as the current real estate market remains depressed then big opportunities will present themselves every single day.

It’s a sad fact that many people have over-extended on credit and as such have been forced to foreclose and walk away from the family home. Right now the foreclosure market is running hot due to record numbers of defaults in the US. Smart cashed-up investors are very much aware of this and are ready to purchase homes at well below market value.

Just as many people made money as the market rose many people are making money on the falling market. It still remains true that you make money when you buy. Of course, people will point the finger of blame at everyone else in these situations, it’s sad that families have to lose their homes but at the same time we live in an age where people tend to duck personal responsibility on every level they can. People should be prepared to accept the fact that they got themselves into high levels of debt and be prepared to accept responsibility for their actions.

The property market will take time to recover from the downturn and this will give people time to recover and sort out their financial situations. Lessons will be learned and banks lending criteria will be evaluated and corrected to stop this from happening again. If you are in a situation now where it looks like you stand to lose the house then the best thing you can do is open up the lines of communication with the bank or finance company, they are ready to talk in most cases.

Taking Title When You Buy

If you are a first-time buyer, you are probably wondering what taking title refers to. It is not the act of accepting a piece of paper from the seller. Taking title refers to who is listed on the title and HOW they are listed. If you are not married and are buying the home alone, you can stop reading now because you simply take the title in your own name. If you are married or buying the property with another person, things get a bit complex.

Most buyers take the title in one of three ways – joint tenancy, tenants in common or as community property. Here is a closer look at each.

Joint tenancy is a popular method of taking title. Joint tenancy simply is a co-ownership situation where the purchasing parties are both listed on the title. The advantage of this form of ownership is each person on the title has the right of survivorship, meaning that if one of the owners dies, the title passes automatically to the surviving owner. Joint tenancy also offers tax benefits in the form of a stepped-up basis. It is beyond the scope of this article, but the general idea is that the surviving owner gets to step up the cost of the home, which saves on capital gains taxes.

Tenants in common are essentially partnerships to own a property. They are generally disfavored because of tax issues.

Taking the title as community property occurs often, but the buyers often do not realize it. If you are in a community property state, such as California, you pretty much take title as community property unless you hire a lawyer to find a way not to. Community property states have an overriding policy that funds from the estate of a married couple, not to mention assets, are jointly owned by both regardless of anything in writing. There are, however, some advantages to this approach. Upon the death of one spouse, the other gets a major stepped-up basis on the cost of the home. When the property is sold, this results in substantial savings on capital gains.

So, which title should you choose when buying a home? There really is no one correct answer. You simply need to analyze your specific circumstances to make the best choice.
